These terms and conditions apply to purchases from BarGear through our webshops and relevant markets.

2. Prices and payment

The applicable prices, currency, VAT, any deposit and other charges are shown in the webshop and market where you shop. The total order price, including any delivery costs, is shown at checkout before you complete the purchase.

The payment methods currently available for your order are shown at checkout. We do not charge more than the amount you approved in connection with the purchase.

You must be at least 18 years old to shop at BarGear. Public institutions and EAN customers are welcome to contact customer service before ordering.

3. Ordering and contract

When you place an order, you receive an electronic confirmation. If, exceptionally, we cannot accept or complete the order, we will contact you as quickly as possible and return any amounts that should not be charged.

You are responsible for ensuring that the information you enter when ordering is correct.

4. Delivery

The delivery methods, shipping prices and estimated delivery times available for your order and delivery address are shown at checkout. Availability may vary depending on market, address, order size, stock status and product type.

In-stock items ordered on business days before 13:00 are normally dispatched the same day under normal warehouse handling. Weekends, public holidays, larger orders, payment or address checks and carrier conditions may affect dispatch and delivery. Same-day dispatch is not a guarantee of next-day delivery.

When tracking is available, you receive tracking information when the order is dispatched.

If a parcel is not collected and is returned to us, the actual costs of the unsuccessful delivery and return may be deducted from the refund to the extent permitted by law.

5. Right of withdrawal for consumers

As a consumer, you generally have a statutory 14-day right of withdrawal for distance purchases. The period normally begins on the day when you, or a third party designated by you other than the carrier, take physical possession of the goods. For an order containing several goods delivered separately, the period begins when the final item is received.

If you wish to exercise your right of withdrawal, you must give us an unambiguous notice before the deadline, for example by emailing info@bargear.dk or using our contact form.

After notifying us that you withdraw from the purchase, the goods must be returned without undue delay and no later than 14 days after your notice. You bear the direct cost of returning the goods unless otherwise agreed.

For a valid withdrawal, we refund the payments received from you, including the least expensive standard delivery option we offered at the time of purchase. Any additional delivery costs resulting from your choice of a more expensive delivery method are not refunded. We may withhold the refund until we have received the goods back or you have provided evidence that the goods were returned, whichever occurs first.

You are only liable for any reduction in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

The statutory exceptions to the right of withdrawal apply, including among other things goods made to the customer’s specifications, goods liable to deteriorate or expire rapidly and certain sealed goods where the seal has been broken after delivery.

6. Business customers

For business purchases, BarGear offers a voluntary return period of 3 days from receipt unless otherwise agreed in writing. This business return option is not a statutory right of withdrawal and may be subject to special terms for the specific order.

7. Complaints and defects

When you shop as a consumer, Danish rules on defects apply, including generally a 24-month complaint period. A complaint must concern a defect for which BarGear is responsible and not, for example, damage caused by incorrect use or other damaging conduct after delivery.

You must complain within a reasonable time after discovering the defect. If the complaint is justified, we cover the reasonable costs necessary to handle the complaint.

For food products and other goods with limited shelf life, any defect is assessed in relation to the nature of the product, its shelf life and the specific circumstances.

We do not accept cash-on-delivery parcels. Always keep proof of shipment.

9. Complaints procedure

If you are a consumer and have complained to us without reaching a solution, you may, subject to the applicable rules, submit the case to the relevant complaints body. For ordinary consumer purchases in Denmark, this will typically be the Danish Consumer Complaints Mediation Team/Consumer Complaints Board through Nævnenes Hus.

Customers in other EU/EEA countries may also seek guidance from the relevant European Consumer Centre in their country of residence.

10. Marketing

You only receive electronic marketing from us when there is a valid legal basis under applicable rules. If the marketing is based on your consent, you can unsubscribe at any time using the unsubscribe link in the communication or by contacting us.

11. Personal data

Information about how BarGear processes personal data is available in our privacy policy.

12. Cookies

We use necessary cookies to operate the webshop and may, where permitted by law, use other cookies for analytics and marketing based on your choice or consent. You can manage your cookie choices through the website’s cookie settings.

13. Price Match

BarGear’s Price Match applies before purchase. If you find the exact same in-stock item cheaper at a relevant webshop in the market where you are shopping, you can contact us with a publicly available link or other documentation.

Price Match requires, among other things, that the brand, product, variant, size or quantity and condition are identical, that the item is in stock at the competitor and that the offer is available to ordinary customers. We may take into account unavoidable costs required to purchase and receive the item on comparable terms.

On bargear.dk we compare with Danish webshops, on bargear.se with Swedish webshops and on bar-gear.de with German webshops. On bargear.eu we compare with established EU webshops that deliver to the customer’s delivery country on comparable terms.

Price Match does not apply to private sellers, marketplace sellers, obvious pricing errors, special membership or loyalty prices, personal discount codes, individually negotiated B2B prices or products that are not directly comparable. Public campaign prices can be included when the other conditions are met.

14. Governing law

The agreement is governed by Danish law. If you shop as a consumer in another country, this does not limit any mandatory consumer rights you may have under the law of your country of residence.

15. Changes

We may update these terms and conditions when our services, processes or applicable rules change. The version that applied at the time of your purchase applies to that specific order.
